Overview

This website is operated by Abigail Hemmings Art. Throughout the site, the terms “I”, “me”, and “my” refer to Abigail Hemmings Art. By visiting this website or purchasing from me, you agree to be bound by these Terms of Service.

These terms apply to purchases of original artwork, fine art prints, and commissioned artwork made through this website or directly with me.

Products and availability

I offer original artwork, fine art prints, and commissioned artwork.

All artwork is subject to availability. I reserve the right to update, withdraw, or amend products, prices, and descriptions at any time.

Product descriptions

I take care to describe and photograph my work as accurately as possible. Please note that colours may vary slightly depending on screen settings, photography, and print processes.

Sizes, materials, and presentation details are listed as accurately as possible on each product or commission page.

Prices and payment

All prices are shown in GBP (£).

Payment must be made in full before ready-to-ship originals or prints are dispatched, unless otherwise agreed in writing.

For commissions:

  • commissions under £300 require full payment upfront
  • commissions of £300 and over require a 50% non-refundable booking fee to secure your slot
  • the remaining balance must be paid before collection or dispatch

A commission is only considered booked once suitable reference photos have been approved, the quote has been agreed, and the required payment has been made.

Commissions

My standard commission service is for realistic pastel animal portraits created from your reference photos.

Commission timescales vary depending on size, complexity, and current workload. Estimated timeframes are discussed when booking.

I include up to three reasonable, stage-appropriate amendments as part of the standard commission process. Any additional or more substantial changes may incur an extra charge.

Because commissions are made specifically for you, they are treated as personalised/custom-made items.

Prints

Open edition and limited edition prints are described individually where relevant.

Unless stated otherwise:

  • open edition prints are supplied unframed and unmounted
  • limited edition prints are supplied as described in the product listing

Originals

Original artworks are sold as described in each listing. Unless clearly stated otherwise, originals are normally sold mounted and unframed.

Shipping and delivery

I currently ship within the UK only.

Orders are sent using tracked and insured delivery where appropriate. Dispatch times vary depending on whether an item is ready to send, made to order, or commissioned.

Any delivery timeframes given are estimates, not guarantees, although I will always aim to dispatch within the stated timeframe or keep you updated where delays occur. UK online sellers must either deliver within the agreed period or, if no period is agreed, within 30 days.

Local collection or hand delivery may be available by arrangement.

Returns and refunds

In summary:

  • commissions are non-refundable unless faulty or damaged in transit
  • originals and prints may be returned in line with my Return & Refund Policy
  • this does not affect your statutory rights

Damaged, faulty, or incorrect items

If your artwork arrives damaged, faulty, or incorrect, please contact me as soon as possible with your order details and clear photographs.

Depending on the situation, I may offer a repair, replacement, refund, or other appropriate remedy.

Intellectual property

All artwork, images, text, and content on this website remain the intellectual property of Abigail Hemmings Art unless otherwise stated.

The purchase of physical artwork does not transfer copyright or reproduction rights.

You may not reproduce, distribute, edit, resell, or use my images or artwork for commercial purposes without prior written permission.

Statutory rights

Nothing in these terms excludes or limits your statutory rights as a consumer. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described, and those rights cannot be excluded by contract terms.
